In this short discursive essay, the author discusses the determination of a duty of care in negligence in light of Lord Atkin’s principle as per Donoghue v Stevenson. The author considers the spirit of Donoghue and whether it is resonant in Caparo Industries plc v Dickman. Developments such as Anns v Merton London Borough Council are considered, but ultimately concluded to be deviations from the Atkin principle which is arguably still resonant in Caparo.
